An appeal is the formal request that a court with appellate jurisdiction review the judgment, decision, or order of a lower court and set it aside (reverse it) or modify it. During the appellate process, you are not allowed to present new facts or to retry old facts. Either party in a traffic matter has a right to appeal a judge’s decision. On appeal you are not allowed to present new facts or to retry old facts.

Virgin Islands Superior Court Rule 322 governs appeals of all final orders or judgments of a Magistrate Judge that presided over a Non-Felony Traffic Offense Division.  To file an appeal, you must file a Notice to Appeal with the Clerk of the Superior Court within fourteen (14) days of the date of the entry of the Judgment/Order.
